The probate process begins by filing a petition with the Probate Court. The matter will then be assigned to a probate Judge. Depending upon whether the deceased had a last will and testament naming an executor or whether any disputes exist between the heirs, the process may be streamlined through an independent administration. For obvious reasons, a faster probate administration can be beneficial to the surviving friends and family.

During the process, the decedent’s probate assets will be identified and their debts will be paid to the extent possible. Any remaining assets will be divided in accordance with the decedent’s last will and testament, or if they died without a will, pursuant to Texas law.
